The Service provides text messages with resources supporting early childhood education. The Service provides messages based on preferences you share with the Service. This Privacy Policy details how we may collect and use your personal information.

The Brazelton Touchpoints Center, on behalf of the National Center on Parent, Family, and Community Engagement (NCPFCE) and our vendors, respect your privacy and personal information. Personal information is collected by contacting us via phone, email, or through the Text4FamilyServices page on the Early Childhood Learning and Knowledge Center (ECLKC). Personal information means any information: (i) that identifies or can be used to identify, contact, or locate the person to whom such information pertains, or (ii) from which identification or contact information of an individual person can be derived. Personal information includes, but is not limited to, first and last names, phone numbers, and in some cases, email addresses. In providing the Service, we receive personal information from you and we may send personal information to you.

In connection with the Service we provide, we may ask you to provide your zip code, mobile number, and email address to troubleshoot any issues you might have with the service and to personalize the service information for you. By giving us this information, you are giving us your consent to use your personal information as set forth in this Policy.

We may use your personal information to:

  • Provide you with the Service
  • Personalize the Service
  • Provide customer support
  • Take actions to help us obey laws or stop fraud and abuse
  • Take actions to enforce our agreements and policies
  • Manage our operations

We maintain personally identifiable information (PII) associated with your account so that (a) your account may be reactivated, and (b) we may use the data for internal evaluation purposes to learn from and improve upon the program. Unless you advise us otherwise, your PII will be maintained for eight years for the purpose for which it was collected.

We do not sell, rent, or lease your personal information to any third party, nor do we use it for commercial marketing. See the Office of Head Start Privacy Policy for Web-based Services.

We restrict access to PII to those employees within NCPFCE and our affiliates, including the Department of Health and Human Services and vendors, on a need-to-know basis in order to resolve problems with the Service, provide customer support, or to address suspected violations of the Terms and Conditions of the Service. We require each of our employees, consultants, and independent contractors to sign confidentiality and non-disclosure agreements. We also instruct them on how to properly secure PII. We may, on occasion, hire other companies to provide a part of the Service on our behalf. If any such entity has access to personal information, we require them to sign confidentiality and non-disclosure agreements and prohibit their use of such information beyond the Service they are providing on our behalf.

You have a right to request a copy of your personal information. Your personal information will be provided to you within 30 days of our receipt of your request. You also have a right to request that we delete any PII that we store and we shall delete it within 90 days of our receipt of your request. For either request, please email PFCE@ecetta.info.

Disclosures Required by Law

We may access and disclose personal information if required by law or in our good faith belief that such action is necessary to: (i) conform to the edicts of the law or comply with legal process served on us, or (ii) act in urgent circumstances to protect the personal safety of users of our Service or members of the public. To the extent practicable and legally permitted, we will attempt to advise you prior to any such disclosure so that you may seek a protective order or other relief limiting such disclosure.

Changes to Our Policy

We reserve the right, in sole and absolute discretion, to change this Privacy Policy in whole or in part at any time. Changes in this Privacy Policy will be effective when posted to the ECLKC website. Your continued use of the Service after changes to the Privacy Policy have been posted to the ECLKC will be deemed to be your acceptance of those changes.

When we make changes to this Privacy Policy, we will revise the ‘last modified’ date at the top of the Privacy Policy.  We will attempt to notify you via text messaging about any material changes to this Privacy Policy. We encourage you to review this Privacy Policy periodically to stay informed about how we are helping to protect your personal information.

Text4FamilyServices: Terms and Conditions

The mobile information service (the “Service”), including all of its features and content, is provided by Brazelton Touchpoints Center on behalf of the National Center on Parent, Family, and Community Engagement (NCPFCE) (the “Service Provider”). It may be used solely pursuant to the terms and conditions set forth herein (“Terms and Conditions”).

Your use of the Service is further subject to the terms of our: (i) Privacy Policy, (ii) Copyright and Trademark Notices, and (iii) Acceptable Use Policy. Each is posted on the Early Childhood Learning and Knowledge Center (ECLKC) website, as well as any modifications to these and other policies established by the Service Provider. Use of the Service constitutes your agreement to be bound by all of these Terms and Conditions and any and all guidelines and policies established by the Service Provider. It also establishes your agreement that, should you object to any term or condition, guidelines, policies, or any subsequent modifications thereto or become dissatisfied with the Service in any way, your only recourse is to discontinue use of the Service.

Limited License

Subject to these Terms and Conditions, you are granted a non-exclusive, non-transferable, revocable, unlimited license to access and use the Service for educational and non-commercial use. You may not use the Service when such use includes or results in, directly or indirectly, the sale of the Service. The Service Provider may revoke this license at any time, for any reason. The Service content is only for your personal use.

You are prohibited from copying, publishing, distributing via the Internet or other public computer-based information system, or creating derivative works, including transferring, selling, leasing, licensing, or otherwise making available to any unauthorized party the Service, in whole or in part, or any content contained in the Service.

Disclaimer

The Service is provided “as is,” without any representation or warranty, express or implied, of any kind, including but not limited to warranties of merchantability, non-infringement, or fitness for any particular purpose. The service providers do not warrant the accuracy or completeness of the service, the suitability of the content or the reliability of any advice, opinion, statement, or other information displayed or distributed through the services. You acknowledge that any reliance on any such opinion, advice, statement, memorandum, or information shall be at your own risk. The Service Provider does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that this website is free of viruses or other harmful components.

Neither the Service nor the Service Provider is offering advice for dealing with specific classroom situations or situations serving individual children. The Service is intended for general information purposes. It is not a substitute for the policy and procedures of your institution.

Information You Provide

Any personally identifiable information you provide to the Service Provider via the Mobile Service is protected by and subject to our Privacy Policy.

Access or Delivery to Mobile Network Is Not Guaranteed

Delivery of information and content to or from a mobile device may fail due to circumstances or conditions beyond the Service Provider’s control. You understand and acknowledge that network, services, including but not limited to mobile network services, are outside of the Service Provider’s control and the Service Provider is not responsible or liable for such problems.

Message Transmission and Delivery by Your Network Operator

You understand and acknowledge that your use of the Service from a terminal such as, by way of example and without limitation, a mobile device or personal computer is subject to any agreements you have with your network service provider. Message and data rates may apply when calling phone numbers or linking to websites or videos in Text4Teachers messages.

Text and Email Messages Are Not Encrypted

Email and text message communications from the Service are not encrypted and, therefore, can be read if intercepted while in transit. Although the Service Providers’ use of this information is governed by the Privacy Policy, it is possible for these communications to be intercepted or accessed without your authorization.

By using the Service, you hereby release the Service Provider, its officers, directors, members, employees, contractors, agents, successors, assigns, and all of their affiliates, subsidiaries, licensors, co-venturers, and partners, from any and all liability arising from or related to any such unauthorized access.

Once delivered to your device or email server, text and email messages are under your control and are your responsibility. You hereby release the Service Provider, its officers, directors, members, employees, contractors, agents, successors, assigns, and all of their affiliates, subsidiaries, licensors, co-venturers, and partners, from any and all liability arising from or related to access to email and/or text messages.

You acknowledge that certain operators do not support or offer certain mobile network services, such as delivery of messaging and mobile Internet access. You understand and agree that the Service may not, in part or in whole, be available to you if your mobile network operator does not support it in a standard that conforms to the Service.

In no event shall the Service Provider or any of its officers, directors, members, employees, contractors, agents, successors, assigns, and all of their affiliates, subsidiaries, licensors, co-venturers, and partners, be liable to an entity for any direct, indirect, special, consequential, punitive, or other damages of any kind whatsoever (including, without limitation, lost profits or revenue, business interruption, loss of information or programs, or other data on your information handling system) that are related to the use of, or the inability to use, the Service (including any errors or omissions), materials, and functions of the Service, or any linked website, even if the Service Provider is expressly advised of the possibility of such damages.

The Service Provider may, in its sole and absolute discretion, terminate, change, suspend, or discontinue any aspect of the Service, including the availability of any features, at any time. The Service Provider, in its sole and absolute discretion, may also impose limits on certain features and Service or restrict your access to parts or all of the Service without notice or liability.

Changes in Terms and Conditions

The Service Provider reserves the right, in its sole and absolute discretion, to change, modify, add, or remove any portion of these Terms and Conditions in whole or in part, at any time. Changes in these Terms and Conditions will be effective when posted. Your continued use of the Service after any changes to the Terms and Conditions have been posted will be deemed to be your acceptance of those changes.

When we make changes, we will revise the “last modified” date at the top of the Terms and Conditions. For material changes to Terms and Conditions, we will attempt to notify you via text. We encourage you to review this statement periodically.

Suspension/Termination

The Service Provider may determine, in its sole and absolute discretion, that you are in, or have been, in violation of these Terms and Conditions. If such a determination is made, then the Service Provider, in addition to any other available remedy at law or in equity, may suspend or terminate providing the Service to you.

This website and the Service is controlled by the Service Provider from its offices in the United States. The Service Provider makes no representation that materials associated with the Service are appropriate or available for use at other locations outside of the United States. Access to them from territories where their contents are illegal is prohibited. You may not export the materials in violation of U.S. export laws and regulations. If you access from a location outside of the United States, you are responsible for compliance with all local laws. These terms and conditions of use shall be governed by the laws of the District of Columbia, without giving effect to its conflict of laws provisions.

You will not use the Service to transmit, either directly or indirectly, any bulk mobile messages or unsolicited commercial mobile messages. You will not use the Service in any way that violates the Service Provider’s Acceptable Use Policy. A breach of any part of the federal anti-spam laws or the Service Provider’s Anti-Spam Policy is a breach of the Terms and Conditions and certain federal and state laws. Such violations may subject the sender and his or her agents to civil and criminal penalties.

If for any reason a court of competent jurisdiction finds any provision of these Terms and Conditions or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of such provision as nearly as possible, and the remainder of these Terms and Conditions shall continue in full force and effect.
